			<content:encoded><![CDATA[<p>Well, it looks like I&#8217;ve got more reason to write than ever before.  And I thought that <em>going back to school</em> was going to be a big deal and worth writing about.  If only I&#8217;d known&#8230;</p>

<p>So, for the one of you still reading this that doesn&#8217;t already know &#8212; and I suspect that my readership has fallen to zero at this point &#8212; I&#8217;m going to be having a baby.  Char and I will become parents on or around May 23 next year (if Ali has her way, it&#8217;ll be May 22, but I don&#8217;t know that we&#8217;ll be <em>that</em> obedient).</p>

<p>I&#8217;m &#8230;  ambivalent about this.  Anyone that knows me even a little knows well my feeling on the subject of my having offspring.  I&#8217;ve never made a secret of it.  But I can&#8217;t really cling to those feelings at this point, otherwise I&#8217;ll do far worse as a parent than my child-to-be deserves (speaking of which, since the Internet is forever, there&#8217;s a good chance they&#8217;re reading this.  Hi, offspring!)</p>

<p>So, I&#8217;m reanimating this blog.  I expect it&#8217;ll have a different tone than before, and don&#8217;t be shocked if there are posts that are either private or don&#8217;t allow feedback &#8212; this is likely to become a bit more of a public diary than a sounding board, but you&#8217;re all welcome to participate.  Who knows, perhaps it&#8217;ll make things easier to adjust to.</p>

			<content:encoded><![CDATA[<p>Buried under the avalanche of holiday-related product placements that hit once every year for about, oh, <em>three months</em>, a major change in Canadian copyright legislation is about to take place, and &#8212; despite Minister of Industry Jim Prentice&#8217;s claim that this change will &#8220;put consumers first,&#8221; there&#8217;s little enough of that to be seen in the proposed legislation.</p>

<p>Now, I&#8217;m not going to parrot the analysis here, because one of the biggest friends that this type of law has is an uninformed populace.  What I&#8217;d ask instead is that you (the two of you still reading this after my long silence) spend a morning informing yourself about the way laws like this will affect your freedom to consume and produce art in the Canada we&#8217;ll live in for the foreseeable future.  If you need a starting point, as I&#8217;m sure that you do, I can offer a couple:</p>

<p>If you want a great video showing you what is happening in the US &#8212; whose <a href="http://en.wikipedia.org/wiki/Digital_Millennium_Copyright_Act" title="Wikipedia Entry: Digital Millennium Copyright Act">DMCA</a> is the template for the act that will be introduced in Canada sometime in the next week and a half &#8212; then I recommend <a href="http://en.wikipedia.org/wiki/Lawrence_Lessig" title="Wikipedia Entry: Lawrence Lessig">Lawrence Lessig</a>&#8217;s TED talk: 
<a href="http://www.ted.com/index.php/talks/view/id/187">How Creativity is Being Strangled By the Law</a>.  It&#8217;s 20 minutes, but it&#8217;s well worthwhile.</p>

<p>If you&#8217;re more inclined for a local perspective, you can do far worse than <a href="http://www.michaelgeist.ca/">Michael Geist</a>&#8217;s <a href="http://www.michaelgeist.ca/tags/canadian+dmca">Canadian DMCA articles</a>.  Geist is a lawyer specializing in the internet &#8212; specifically issues with respect to privacy and e-Commerce, and he&#8217;s one of our best early-warning systems for dangerous copyright legislation.</p>

<p>And, in the end, if you come to the end of these links &#8212; and <em>please</em> at least skim them &#8212; and you want to do something, there&#8217;s an article on <a href="http://www.michaelgeist.ca/content/view/2431/125/">what you can do</a>, too.  I, for one, am going to be contacting Laurie Hawn and Jim Prentice.  Hopefully on some level they listen.</p>

  technological process at this early stage of their development and use

  from old, a process which has been ongoing for almost all of human

  available again.  The question is, with what will these newly-enabled
  artists create?  What will be their raw material?  Moreover, how will
  others see their work?  The restrictive legislation that is to be
  tabled later this month lacks critical provisions for fair use and for
  reverse engineering, both of which are driving forces of invention.</p>
  
  <p>Make no mistake, I am not a &#8216;copyleft&#8217; fanatic; I am a software
  developer by trade and I make my living on copyright and the
  protections it provides.  I do not wish to see a regime wherein my
  work is freely available without compensation to any Tom, Dick, or
  Harry who decides that they want it.  Moreover, my friends who are
  artists run the gamut from the &#8220;give it away&#8221; to the &#8220;it&#8217;s mine and I
  should be paid for it&#8221; on the spectrum.  What is true, however, is
  that the legislation that you are expected to introduce this month
  will hurt <em>all</em> of us in ways that are eminently predictable, since we
  have the immediate example of the United States to see.</p>
  
  <p>In conclusion, I ask that you reconsider your stance on consumer
  consultation before introducing this bill.  When creating content has
  become so trivial (witness YouTube, although perhaps you&#8217;ll share my
  sense of disappointment with most of that content) it&#8217;s important to
  realize that the only difference between a &#8216;consumer&#8217; and a &#8216;creator&#8217;
  in this century is likely to be in the size of their wallet.</p>

<p>So, in response to some vigourous prodding last night, I felt it was time to dust this off and get back to keeping people apprised of my life.</p>

<p>Here&#8217;s the skinny, since&#8230;  holy shit! November 6!  It&#8217;s been almost four weeks!</p>

<p>Since then, I have:</p>

<ul>
<li>Travelled to the Dominican Republic (where we were all amiss in not posting to <a href="http://www.offby1.net/morruz">Morruz</a>)</li>
<li>Dislocated my shoulder&#8230; <em>again</em>.  That sucked.  Worse?  I was just playing volleyball in a pool, not even doing anything interesting.  Funny thing is, though, when I went to a medical supply store to get some foam to pad the <em>horrid</em> sling I took home with me, the lady running the store told me that my injury seems to be quite common in volleyballers, at least anecdotally.</li>
<li>Got my performance review at work, for which the term &#8220;glowing&#8221; might be an understatement.</li>
</ul>

<p>And you wonder why I don&#8217;t post? <img src='http://www.offby1.net/wordpress/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' />   My life is dull, dull, dull.</p>

<p>It hasn&#8217;t even been that interesting of a time, politically.  I&#8217;ve kept my eyes on the news, but there&#8217;s been little out of the ordinary to spark thought or discussion, either north or south of the border.</p>

<p>Oh, the bliss of having <em>weekends</em> again; of being able to read guilt-free.  Of playing games, of having days that end at 5 pm <em>some</em> of the time, even if not all of the time.</p>

			<content:encoded><![CDATA[<p>I&#8217;ve got only three days before Ms. Charlotte and I take off into the blue yonder, across the pacific (a first, at least as far as reaching the other side goes &#8212; Hawaii doesn&#8217;t count) to Japan, where we&#8217;ll be roaming around and posting pictures (over at <a href="http://www.offlineblog.com/morruz">Morruz</a>), as per SOP).</p>

<p>I&#8217;ve got just about everything taken care of, on this end; I&#8217;ve finished (as far as I&#8217;m going to) my paper for Cmput 401, I&#8217;ve got most of the written assignment for 414 finished, and a deferral on my 3000-word essay to a week after I get back.</p>

<p>On the work front, I&#8217;ve been putting in a bit of time off the books because I wanted to get some coding done, which wasn&#8217;t happening with all of the container management stuff I was doing.  Oh, it pays the bills, but struggling with IBM&#8217;s toolset was one of the least fun things I&#8217;ve ever had the &#8230; <em>pleasure</em> &#8230; of doing.</p>

<p>So, that&#8217;s it.</p>

<p>I&#8217;m taking one of the few real vacations I&#8217;ve had in my life, since leaving home.  Oh, I&#8217;ve been unemployed, and I&#8217;ve been off for a few days here and there, but this type of thing is rare, and I&#8217;m looking forward to the opportunity to travel with Char; we&#8217;ve never done this together.
